These General Terms and Conditions govern the purchase of products through www.byquokka.com, the website of the Quokka brand, owned and operated by STOR, S.L. We recommend reading them carefully before placing an order.

1. Subject matter and parties
These General Terms and Conditions of Purchase govern the acquisition of products through the website www.byquokka.com, marketed under the Quokka brand and managed by:

For the purposes of these Terms, the selling company is STOR, S.L., while Quokka is the commercial brand used on the WEBSITE.
These Terms are the only ones applicable to the purchase of products through the WEBSITE, unless there is an express written agreement between the user and STOR, S.L. Placing an order implies full acceptance of these Terms as published at the time of purchase.
To purchase through the WEBSITE, the user must be over 18 years of age and have sufficient legal capacity to enter into contracts.

2. Purchase process
To place an order through the WEBSITE, the user must follow the steps set out below:
- Access the website www.byquokka.com.
- Select the desired product and review its description, features, availability and price.
- Choose the number of units and click "Add to cart".
- Once the product has been added, the user may continue shopping or proceed to checkout.
- In the cart summary, the user may review the selected products, change quantities and apply any valid discount codes or coupons.
- To continue, click the button to proceed to checkout.
- If the user already has an account, they must log in with their credentials. If not, they may register by completing the relevant form.
- The user may then review and, if necessary, update the delivery address and billing address, and add any comments regarding the order.
- The user may then select the available shipping method for their order.
- Before confirming the purchase, the user must tick the box accepting these General Terms and Conditions.
- Finally, the user may choose the available payment method and confirm the purchase.
Once the process has been completed successfully, STOR, S.L. will send the user an order confirmation by email within a maximum of 24 hours.
Although stock is updated automatically, if an order is accepted in error for an unavailable product, STOR, S.L. will notify the user as soon as possible and offer the choice between a full refund of the amount paid — to be processed within a maximum of fourteen (14) calendar days — or a replacement with a product of similar characteristics, if available.
3. Prices, taxes and invoicing
All prices shown on the WEBSITE are expressed in euros (€) and include VAT and any other applicable indirect taxes at the time of purchase.
Shipping costs are not included in the product price unless expressly stated otherwise, and will be shown separately before the order is finalised, based on the delivery address and the selected shipping method. Further information is available on the Shipping times and costs page.
STOR, S.L. may run promotions, discounts or special campaigns. In such cases, the applicable conditions will be shown on the WEBSITE.
STOR, S.L. reserves the right to modify prices at any time. However, the price applicable to an order will be the one published at the time the user confirms the purchase, except in the case of a manifest error.
Invoices will be issued in electronic format. If the user wishes to receive a paper invoice, they may request one by writing to info@byquokka.com, stating the order reference and the postal address to which it should be sent.
4. Payment
The user may pay by credit or debit card, or via PayPal, according to the methods available on the WEBSITE at any given time.
Visa and Mastercard cards are accepted. Card payments are processed through secure connections provided by specialist payment service providers.
If the user detects an improper or fraudulent charge related to a purchase made on the WEBSITE, they should notify us as soon as possible at info@byquokka.com so that we can help resolve the issue.
STOR, S.L. does not directly store the full payment details used by the user. Such data is processed by the relevant payment providers in accordance with their own policies and security measures.
5. Shipping and delivery
STOR, S.L. will only ship products purchased through the WEBSITE to addresses located in the countries enabled at the time of purchase. If the system does not allow a particular country or address to be selected, the order cannot be placed for that destination. Available destinations are listed on our Shipping times and costs page.
The maximum delivery period is 30 calendar days from order confirmation, unless a different period is indicated before purchase. As a general guide, domestic orders may be delivered within 24 to 48 hours and international orders within 2 to 5 working days, although these timeframes are estimates and not guaranteed.
The user is responsible for providing a correct, complete and suitable delivery address. STOR, S.L. will not be liable for delays or incidents resulting from errors in the information provided by the buyer.
Delivery shall be deemed to have taken place when the user, or a third party designated by the user other than the carrier, takes physical possession of the products.
The risk of loss or deterioration of the products shall pass to the user from the moment the user, or a third party designated by the user other than the carrier, takes physical possession of the goods.
6. Obligations of the parties
6.1. Obligations of STOR, S.L.
- Process orders placed through the WEBSITE correctly.
- Provide the buyer with essential information about the product, price and purchase process.
- Deliver the purchased products under the applicable conditions and within the applicable timeframes.
- Handle enquiries, incidents, returns and complaints in accordance with applicable regulations.
6.2. Obligations of the buyer
- Pay the price and any applicable charges during the purchase process.
- Provide accurate, truthful and complete data required to process the order.
- Review the order information before final confirmation.
- Use the WEBSITE appropriately and not in a fraudulent or bad-faith manner.
- Be liable, where applicable, for any damages resulting from misuse of the service or breach of their contractual or legal obligations.
7. Right of withdrawal
Users who qualify as consumers shall have the right to withdraw from the contract within fourteen (14) calendar days without giving any reason, counted from the date on which the user, or a third party designated by the user other than the carrier, takes physical possession of the products.
To exercise the right of withdrawal, the user must communicate their decision to STOR, S.L. in an unambiguous manner, either by email to info@byquokka.com or in writing to the postal address indicated in these Terms.
The user may, if they wish, use the withdrawal form set out below, although its use is not mandatory:

The user must return the products without undue delay and, in any event, no later than fourteen (14) calendar days from the date on which they communicated their decision to withdraw. The deadline shall be met if the return is dispatched before the expiry of that period.
Unless otherwise expressly stated, the direct costs of returning the products shall be borne by the user.
The product must be returned in the same condition in which it was delivered, with its original documentation, accessories, packaging and labelling, to the extent reasonably possible.
STOR, S.L. will reimburse all payments received from the user, including delivery costs corresponding to the least expensive standard shipping method available, without undue delay and in any event within fourteen (14) calendar days of being informed of the decision to withdraw. If the user chose a more expensive delivery option than the standard one, the additional cost will not be reimbursed. However, STOR, S.L. may withhold the reimbursement until the goods have been received back, or until the user has provided proof of return, whichever is earlier.
The reimbursement will be made using the same payment method used by the user for the initial transaction, unless the user has expressly agreed otherwise and provided that the user does not incur any costs as a result.
Partial withdrawals will result in partial reimbursements of the amounts corresponding to the returned products.
In accordance with applicable regulations, the right of withdrawal shall not apply, among other legally provided cases, to products made to the consumer's specifications or clearly personalised. Further information is available on our Returns page.
8. Legal guarantee and complaints
STOR, S.L. shall be liable for any lack of conformity existing at the time of delivery and manifesting within the legally applicable period, in accordance with the provisions of Royal Legislative Decree 1/2007 of 16 November (TRLGDCU) and applicable consumer regulations.
As a general rule, and in the case of new goods purchased by consumers, liability for lack of conformity shall apply for a period of three (3) years from delivery, in accordance with current Spanish consumer law.

STOR, S.L. will endeavour to respond to complaints as quickly as possible and, in any event, within a maximum period of one (1) month from receipt.
9. Liability
STOR, S.L. shall not be liable for any damages arising solely from causes attributable to the user, from improper use of the product, or from incorrect information provided during the purchase process.
STOR, S.L. shall also not be liable for delays or non-performance caused by circumstances beyond its reasonable control, including, without limitation, force majeure, strikes, serious logistics incidents, interruptions to essential services, or actions of third parties for which it is not legally responsible.
Nothing in these Terms shall exclude or limit the liability of STOR, S.L. in cases where such exclusion or limitation is not permitted by applicable consumer law, product liability regulations or any other mandatory rules.
10. Indemnification
The user shall be liable to STOR, S.L. for any damages effectively caused as a result of wilful or negligent breach of these Terms or applicable regulations, including third-party claims arising from the user's conduct where attributable to them.
11. Amendments
STOR, S.L. may modify or update these General Terms and Conditions at any time. New versions will be published on the WEBSITE and will apply to purchases made from the date of publication.
The user may consult the current version of these Terms at any time on this page.
12. Other matters
12.1. Language
The contract may be formalised in Spanish or English, depending on the version of the WEBSITE used by the user. In the event of any interpretative discrepancy between the two versions, the Spanish version shall prevail.
12.2. Severability and interpretation
If any clause of these Terms is declared wholly or partially null, invalid or unenforceable, such declaration shall not affect the validity of the remaining provisions, which shall continue to be fully applicable.
The failure by STOR, S.L. to exercise any right recognised under these Terms shall not constitute a waiver of that right, unless expressly acknowledged in writing.
12.3. Governing law and jurisdiction
These Terms shall be governed by Spanish law.
Where the buyer qualifies as a consumer, any dispute shall be submitted to the courts of the consumer's place of domicile, in accordance with applicable regulations.
Where the buyer does not qualify as a consumer, both parties expressly submit to the courts of the city of Madrid, waiving any other jurisdiction that may apply to them.
